Participation and health requirements

The client is responsible for honestly assessing their physical and technical condition before booking. Article 07
Inherent risks and limitation of liability

Mountain hiking is an activity with inherent risks, including but not limited to: uneven and exposed terrain, sudden changes in weather, falls, sprains, hypothermia, heat stroke, avalanche risk in winter, and encounters with wildlife.

The client voluntarily assumes these risks by taking part in Clas Tours by Davila Quiroz activities. Participation implies express acknowledgement that they:

  • Have been informed about the difficulty level and risks of the tour
  • Take part voluntarily and at their own responsibility
  • Will follow the guide's instructions at all times during the activity
  • Have assessed their physical condition and consider it suitable for the chosen activity

Clas Tours by Davila Quiroz and Santiago Davila Quiroz shall not be liable for damage, injury, loss or accidents occurring as a result of:

  • Inherent and natural risks of mountain hiking

  • Unpredictable weather or terrain conditions
  • Acts of third parties or force majeure

Clas Tours' liability is in any case limited to the amount paid by the client for the contracted service, except in cases of proven intent or gross negligence. This limitation of liability applies to the maximum extent permitted by applicable Swiss law.

Article 08
Insurance

The service price does not include personal accident insurance or mountain rescue insurance for the client.

It is strongly recommended that all participants have:

  • Mountain rescue insurance (in Switzerland, Rega — the Swiss Air Rescue — offers annual patron memberships)
  • Travel insurance covering medical evacuation (especially for participants who do not live in Switzerland)
  • European Health Insurance Card (for EU/EFTA citizens) or international health insurance for everyone else

Clas Tours by Davila Quiroz will under no circumstances bear the costs of rescue, medical evacuation, hospitalisation or repatriation of the client. These costs are entirely the responsibility of the participant or their insurer.

A mountain rescue in Switzerland can cost between CHF 1,000 and CHF 10,000 or more. Don't set out without insurance.

Article 09
Conduct on the trail and the guide's authority

Throughout the activity, the guide's authority is absolute in matters of safety. The guide has the power to:

  • Modify or shorten the itinerary at any time for safety reasons

  • Make emergency decisions without needing group consensus

Participants undertake to:

  • Follow the guide's instructions at all times
  • Respect the natural environment (Leave No Trace principle)
  • Not separate from the group without the guide's express authorisation
